Dead Rising follows the harrowing tale of Frank West, an overly zealous freelance photojournalist on the hunt for the scoop of a lifetime. In pursuit of a juicy lead, he makes his way to a small suburban town only to find that it has become overrun by zombies. He escapes to the local shopping mall, thinking it will be a bastion of safety yet it turns out to be anything but.

Capcom receives a lawsuit in the continuing dispute with Richard Rubinstein's MKR Group...


Following news earlier in the month that suggested Capcom were having issues with the alleged copyright owners of George A. Romero's Dawn of the Dead over the similarities to Dead Rising, Reuters is today reporting that the Japanese games publisher has been issued a lawsuit over the dispute.

Maintaining that Dead Rising is essentially a videogame adaptation of Dawn of the Dead, a spokesperson for the New York based movie production company said that the lawsuit is a result of recent failed discussions.

Reuters reports that Capcom had previously filed a case against the MKR Group in a Californian federal court, seeking a legal declaration that the game did not infringe on copyrights and an injunction to prevent MKR from suing the company.

The Monday filing reads:

"Both works are dark comedies. In both, the recreational activities of the zombies and absurdly grotesque 'kill scenes' provide unexpected comedic relief."

"Both works provided thoughtful social commentary on the 'mall culture' zeitgeist, in addition to serving up a sizable portion of sensationalistic violence."

Previously details on the MKR Group had been a little thin on the ground; however, the lawsuit reveals that Richard Rubinstein is the principle shareholder and president, having previously produced the 1979 horror movie and acting a senior producer of a 2004 remake.

Capcom refused to comment about the lawsuit, though presumably while the dispute continues the chances of seeing the return of Frank West in Dead Rising 2 seems a little thin on the ground.
