The LA Superior Court clears Activision of any wrongdoing related to the Scratch: The Ultimate DJ Controversy...

Publisher Activision has been exonerated from the charges brought against it by Genius Products relating to its Scratch: The Ultimate DJ Game. During legal proceedings yesterday (an Activision statement reads), the LA Superior Court cleared Activision from any wrongdoing while refusing to enforce a restraining order on the publisher.

According to reports that surfaced earlier this week, Genius Products alleged that Activision had conspired with Scratch: The Ultimate DJ's developers, 7 Studio, to hold back the game's development and pass on trade secrets to Activision.

Activision acquired 7 Studio on April 6th but flatly denies any of the allegations made against it by Genius Products, and maintains that Scratch: The Ultimate DJ's development was behind schedule as early as last October (according to Genius Products' own admissions).

In fact, Activision has even accused Genius Products of attempting to divert attention away from its own cash flow, revenue, and liquidity problems (detailed in a recent SEC filing) by bringing these charges to the fore.

The gloves are off, it would seem. Activision is also developing a DJ rhythm game, entitled DJ Hero, that's scheduled for release later this year.

"Activision did not interfere with or delay their efforts to complete the game. In fact, Activision provided the fledgling developer [7 Studio] with much needed financing during these difficult economic times," the publisher commented in a press release.

Who knows what's going on with these legal proceedings. Expect Scratch to suffer delays whatever the case though.

The fate of DJ Hero may actually rest with the courts as well. If Activision is found to have purposely held back the Scratch project, then it might have to make huge damage payments to Genius and hold back the release of DJ Hero.
