20th Century Fox unveils the identity of the actor in negotiations to play the tormented titular cop...
Having originally green-lit the project in 2005, it's reported in Variety that 20th Century Fox is in negotiation with Mark Wahlberg to play the titular cop in the upcoming Max Payne movie.
Wahlberg, whose previous credits include The Departed and The Perfect Storm, is currently filming Peter Jackson's adaptation of The Lovely Bones, a novel originally released in 2002.
The Max Payne brand is still owned by Take-Two Interactive, and hasn't been since the 2003 release of Max Payne 2: The Fall of Max Payne, which was developed by Rockstar Vienna (now defunct) and Remedy Entertainment (currently working on Xbox 360/Vista exclusive, Alan Wake).

Yeah they did - but 3D Realms don't have any interest in Max Payne anymore, Rockstar owns the IP.
