The ESRB ratings database suggests that the previous two Max Payne games are heading to Xbox Live Marketplace...

The US Entertainment Software Ratings Board (ESRB) has added the Xbox 360 to its list of rated platforms for Max Payne and its sequel The Fall of Max Payne, sparking rumours that the two titles are set to appear on the Xbox Live Marketplace.

Both the original, released in 2001, and the sequel that was released in 2003 have previously been rated M for Mature, although the addition of an Xbox 360 platform label on the ESRB database usually means only one thing where old games are concerned: they're probably heading to the Xbox Live Marketplace and, in the case of these two titles, most likely as Xbox Originals.

With the announcement of Max Payne 3 by Rockstar last week, it certainly makes a lot of sense that the publisher would decide to re-release the previous games for the current generation. We'll let you know more as soon as news breaks.

Yeah they did - but 3D Realms don't have any interest in Max Payne anymore, Rockstar owns the IP.
